Due to the decrease in the school-age population and the weakening of the finances of private school foundations, the crisis of the existence of private schools such as private universities is approaching reality, which is also affecting the local economy. In order to solve this problem, there are cases in which the basic assets of private schools are donated and collected to make them public and consolidated. Pohang 3rd and 4th generation synchrotron radiation accelerators, which cost more than 50 billion Korean won every year, are the basic property of Pohang University of Science and Technology, a private university, the National Assembly, the government, and school corporations all agreed to the nationalization of the synchrotron radiation accelerator, and through the revision of the Private School Act in 2014, donations to the state were carried out in 2017, laying the foundation for stable operation. This study examines the process that laid the legal foundation for the free donation of the basic property of private schools to the public. If publicization or consolidation (closure of schools, etc.) is carried out later, it is proposed as a way to gradually solve social problems such as temporary large-scale restructuring of manpower. In addition, it is proposed that state-owned property can be stably operated when private schools operate only when the management consignment period of state-owned property can be extended more than twice exceptionally as in the United States.
