The Korea Local Administration Review

The purpose of this study is to analyze the bylaws of the local governments that have been enacted to encourage social participation among the middle and old aged and to confirm whether their structures and contents meet the needs of the middle and old aged and suits with formal requirements. To this end, Yun's criteria for evaluating legislation was utilized. The target bylaws included the relevant codes, considering the fact that social participation is usually referred to as ‘second cropping of the life’ or ‘redesigning of the life.’
According to the analysis, each bylaw observed most formal requirements, but major clauses were the optional clauses which strengthened local government's discretionary power. Especially, none of the analyzed ordinances had clauses that stipulated residents' rights and the remedial measures to the violated rights. This study discusses the significance of the analysis, and it suggests a future direction of development, focusing on the rights of residents, the obligations of local governments, and the delivery system.
