The Korea Local Administration Review

This study aims to examine how much the enactment power of local government follow the principle of subsidiarity. This study analyzes the reason of request for reconsideration, the contents of municipal by-law, geographical distribution of municipal by-law, the relations between orderer and demander of reconsideration, the characteristic for demander of reconsideration, the result of reconsideration, the necessary period for it. Cases of reconsideration of municipal by-law for eight years from fourth to fifth stage on popular local election in Korea are analyzed. In conclusion, this study suggests that enactment power of local government in Korea have to enhance to guarantee the community creativity, to respect the community autonomy, to value the community diversity, and to emphasize the community functional efficiency.
